The following are summaries of rules recently filed by IDPH; they are at various stages in the rulemaking process. The emergency and proposed rules listed here have been or soon will be published by the Secretary of State in the Illinois Register. Click on the name of the rule to view the full text. In viewing the full text, new language added to a current rule would be shown by underscoring and deleted language would be shown with ~~strikeouts~~. Rulemakings proposing to add a new code do not require underscoring.

'Emergency rules' are effective upon filing with the Secretary of State, for a maximum of 150 days. The public may submit comments to the Department during the 150-day effective period of the emergency rules.

The 'proposed' rules have no legal effect until after they have been through the first and second notice periods; are adopted by the Department and filed with the Secretary of State's Office. The public may submit comments to the Department during the first-notice period of the proposed rules. The adopted rules may differ from those originally published.

Control of Communicable Diseases Code (77 Ill. Adm. Code 690) Date Published: March 30, 2018 Illinois Register Citation: 42 Ill. Reg. 5729 Comment Period Ends: May 14, 2018 Submit Comments		This rulemaking seeks to repeal the reporting of six diseases and three subclassifications of a disease based upon an analysis of state and nationwide reportability to the Centers for Disease Control and Prevention (CDC) and other states.

Food Service Sanitation Code (77 Ill. Adm. Code 750) Date Published: June 8, 2018 Illinois Register Citation: 42 Ill. Reg. 9136 Comment Period Ends: July 23, 2018 Submit Comments		This proposed Part is a companion to a proposed repeal of Part 750. Because significant portions of Part 750 had been repealed in previous rulemakings the Department is proposing to repeal the old Part 750 and adopt a new Part 750. Additionally, this rulemaking implements P.A. 100-0194 regarding the certification of food service sanitation managers. This rulemaking seeks to make modifications to the Illinois food establishment inspection report, including elimination of the current grading system in order to make the Illinois report more consistent with the Food and Drug Administration (FDA) model code and report form.

Lead Poisoning Prevention Code (77 Ill. Adm. Code 845) Date Published: August 17, 2018 Illinois Register Citation: 42 Ill. Reg. 15784 Comment Period Ends: October 1, 2018 Submit Comments		The purpose of the proposed rulemaking is to implement Public Act 98-690 while introducing language to provide clarity to existing processes utilized by the Department. This rulemaking reduces the blood lead poisoning level from ten to five micrograms per deciliter.

Community-Based Residential Rehabilitation Center Demonstration Program Code (77 Ill. Adm. Code 220) Date Published: April 27, 2018 Illinois Register Citation: 42 Ill. Reg. 7655 JCAR meeting: August 14, 2018		This rulemaking seeks to update the alternative health care delivery model for community-based residential rehabilitation centers including admission practices, individual rehabilitation plan of care, medication administration, personnel qualifications, staff training, and food service supply requirements. These centers provide rehabilitation or support, or both, for persons who have experienced an acquired brain injury.

Emergency Medical Services, Trauma Center, Comprehensive Stroke Center, Primary Stroke Center, and Acute Stroke Ready Hospital Code (77 Ill. Adm. Code 515) Date Published: April 6, 2018 Illinois Register Citation: 42 Ill. Reg. 6024 JCAR Meeting: July 17, 2018		The proposed rulemaking seeks to implement P.A. 96-1469, P.A. 98-0973, P.A. 99-0319 and P.A. 99-0661. P.A. 96-1469 granted authority to the Department to adopt minimum standards for critical care providers via administrative rulemaking; P.A. 980973 adopted comprehensive new national EMS education standards for three separate classes of EMS licensees and creates one new category of EMS provider (AEMT); P.A. 99-0319 changed the name of the advance directive form from DNR/POLST to POLST; and P.A. 99-0661 amended several definitions.

Hospital Licensing Requirements (77 Ill. Adm. Code 250) Date Published: February 2, 2018 Illinois Register Citation: 42 Ill. Reg. 2088 Effective: May 24, 2018		This rulemaking implements P.A. 99-0383 regarding hospital patient notice of observation status; P.A. 99-0828 regarding sepsis screening protocols; P.A. 99-0480, regarding hospital reporting of opioid overdoses, and PA 99-0048, regarding education materials for avoiding SIDS. This rulemaking also allows an advanced practice nurse or a physician’s assistant with clinical privileges to admit inpatients or outpatients to a hospital and also updates the NFPA life safety requirements and other incorporated references.

Illinois Veterans’ Homes Code (77 Ill. Adm. Code 340) Date Published: January 19, 2018 Illinois Register Citation: 42 Ill. Reg. 1132 Effective: January 5, 2018		This rulemaking deletes the requirements for including the social security numbers on application and renewal forms, and cleans up language to more closely reflect the language of the Nursing Home Care Act.

Long-Term Care for Under Age 22 Facilities Code (77 Ill. Adm. Code 390) Publication: April 13, 2018 Illinois Register Citation: 42 Ill. Reg. 6716 Effective: March 29, 2018		The rulemaking amends language to delete the requirement for including social security n umbers on application and renewal forms, and cleans up language to more closely reflect the language of the MC/DD Act.

Long-Term Care Assistants and Aides Training Programs Code (77 Ill. Adm. Code 395) Publication: April 13, 2018 Illinois Register Citation: 42 Ill. Reg. 6727 Effective: March 29, 2018		The rulemaking seeks to amend the Part to increase the ratio of student-to-instructor for laboratory instructors by one from 15 to 16 students.

Freestanding Emergency Center Code (77 Ill. Adm. Code 518) Date Published: April 27, 2018 Illinois Register Citation: 42 Ill. Reg. 7701 Effective: April 10, 2018		The rulemaking implements P.A. 99-0710 which establishes new requirements for ambulance service to freestanding emergency centers

Sexual Assault Survivors Emergency Treatment Code (77 Ill. Adm. Code 545) Date Published: April 13, 2018 Illinois Register Citation: 42 Ill. Reg. 6577 Effective: August 2, 2018		This rulemaking implements P.A. 99-0801 with regard to written consent for the release of sexual assault evidence to law enforcement for testing, and P.A. 99-0173 which strikes language on written collaborative agreements for advanced practice nurses and delegated authority for physician assistants.

AIDS Drug Assistance Program (77 Ill. Adm. Code 692) Date Published: March 23, 2018 Illinois Register Citation: 42 Ill. Reg. 5167 Effective: June 21, 2018		This rulemaking updates Appendix A with respect to the federal poverty level changing from the 2017 federal poverty level to the 2018 federal poverty level.

HIV/AIDS Confidentiality and Testing Code (77 Ill. Adm. Code 697) Publication: April 6, 2018 Illinois Register Citation: Pending Effective: March 21, 2018		This rulemaking seeks to implement P.A. 099-0054.

Grade A Pasteurized Milk and Milk Products (77 Ill. Adm. Code 775) Publication: April 13, 2018 Illinois Register Citation: 42 Ill. Reg. 6732 Commend Period Ends: March 29, 2018		This rulemaking will update references to several documents that are incorporated by reference in the Grade “A” Pasteurized Milk and Milk Products rules. Documents that are being updated include the Grade A Pasteurized Milk Ordinance (PMO), the Methods of Making Sanitation Ratings of Milk Shippers (MMSR), the Procedures Governing the Cooperative State-Public Health Service/Food and Drug Administration (FDA) Program of the National Conference on Interstate Milk Shipments and the incorporated sections of the Code of Federal Regulations and the Evaluation of Milk Laboratories all published the FDA.
